The title of the article pretty much sums up how hard it is for a man to have custody of his children.

Father gets divorced, ex-wife remarries a sex offender who spent 4 years in jail for sexually assaulting a 15yo step daughter from a previous marriage. Ex-wife takes the girls to live with the sex offender. Father gets worried for his girls safety. Goes to court to get custody.

Court asks ex-wife if it's safe for the girls. Ex-wife says "it's totally safe for the girls to live with my sex offender new husband". Provides evidence of safety (he went to rehab and hadn't been convicted of assault in last 13yrs). Courts responds, "good enough for us". Court rules living with sex offender poses "NO SIGNIFICANT RISK to his daughters"!

Father gets mad, goes to court again to appeal the verdict. Appeals Court upholds initial finding. Girls have to stay with mom and sex offender.

Still think that as a father you have a chance of getting custody? So far this month I've read from local-ish midwest USA newspapers: a mother has kids live with sex offender, a mother put in mental hospital and a mother being arrested for doing meth. In all 3 cases the Father fought for more custody and in all 3 cases the mother retained full custody. (fyi in the mental hospital case the mom was released, then she killed the kids)

Robert Hopkins · Works at USPS April that is a reasonable response and I greatly respect your point of view here. As the father in this case please let me answer some of these questions.

First, I have been involved in my children's lives since day one, literally. They are the center of my world and guide every action I take.

The fact is that this case was even more disturbing than this short article states. After we separated she moved in with a man that later molested her oldest daughter. At the time she was more interested in defending him than supporting her daughter.

I still lay awake at nights remembering her calling her child a "little liar" and how she (the child) just wanted to break them up.

Shortly after she cut off visitation with that daughter which was technically her right given that, even though I had raised this child from the age of six months, I was not her biological father. I was not allowed to present this as evidence given that the child in question was not technically my child.

I was also not allowed to present similar evidence of her using the other children as ransom on numerous occasions.

As for the matter of the current stepfather... who knows what his risk of reoffense is? This information is only available to law enforcement and the mother. Given that they only alluded to it at trial, but never presented it, no one knows.

Justice Connolly noted in his dissent that this places a near insurmountable burden on the non custodial parent. He then goes on to question that if he indeed had a low chance of reoffense then why were these documents not presented at trial?

Holy fuck... imagine having to live under the same room as the man who molests you, and your own mother who is your flesh and blood decides to defend this man. That is seriously fucked up

My boys know their mother won't be able to protect them from day one and that they need to call me in case shit happens.

I lived with abusive alcoholic father and when I was 7 or 8 I told him something along the lines "you're not my father because my father doesn't drink". My mother scolded me right after. She deliberately left me with him, I remember him getting drunk with friends, puking on himself, all that. She didn't mind neither his behavior nor cleaning.

That's codependency. See it once understand it once be able to find it anywhere.

While I understand your actions, I don't think content should be blindly up voted simply because the title proposes a scenario that meets your expectations and validates red pill principles. We should encourage red pillers to seek and value truth, not blindly accept articles as fact simply because they support red pill philosophies. So many causes will quote "statistics" and provide examples of misbehaviour without verifying the sources or data simply because it conveniently supports their case in a meaningful way. We need to be better than the people we shame, mock, and pity.

I know you aren't intending to send that message, but the number of up votes on your comment make me think people just want to read things that support their opinions whether they are true or not.

It depends on the state, the judge, and whether or not you have a court reporter (stenographer) in the courtroom at the time of the trial. I had an attorney on the oppossite side telling me it didn't matter that the mother and boyfriend were abusing my client's kids. There was nothing the court could do about and that my client needed to stop pestering child safety services. This is of course a case where the mother disappeared in the middle of the work day and moved to the other side of the state and couldn't be found for six months till my client hired me.

The children were eight and nine and their telling him they were being abused wasn't allowed as evidence in court because it was hearsay, and luckily my client could afford a child psychologist that analyzed the kids while the kids spent the summer with my client (as part of a ruling for temporary time-sharing).

The judge stated that she had made no finding of the children being in danger and I stood up and asked the judge if she was saying for the record that a mother who takes her children to the other side of the country to live with a boyfriend she support, where both adults spend their days drinking in front of the children, where the boyfriend's children beat up the children, where the mother and boyfriend are gone from the residence for days at a time to only be watched by one of the abusive children, is the superior choice for primary custody over that of a father who has no history of abuse towards the children and can provide a safe environment, mental healthcare, and exclusive attention. Because if that was the case, then the news media needed to be alerted immediately. The judge gave me an angry look and told me not to interrupt her. She paused, asked the parties some questions about what I had said, and then slowly and awkwardly stated that she found while the mother was capable of providing care for the children. Given that the childrens' doctors, larger family (both parents' families lived nearby), and mental health specialist, and that the mother's actions had caused the severe distance without notice to the father, and that the children had a history of complaints of mental and physical abuse. She decided that the father was to have majority time sharing during the school year and that the mother was to have all the off-school vacation time. And that the parents were to either split the costs of plane tickets or meet halfway (halfway between Washington and Florida, ROFLMAO). The judge had to redo the child support guidelines worksheet right there and the other attorney shot me the most evil look (a female attorney I've squared off with who doesn't give a fuck about allegations of abuse). My client did get hit with $5,000 in attorney's fees for his ex-wife (five grand out of twelve grand).

The judged asked me to stay after the trial and gave me a very stern warning about threatening to go to the media. As lawyers in Florida have their first amendment right limited based on the Florida Bar when it comes to fellow attorneys and judges (you can't post opinions online).

I also had one client, whose 12 year old daughter ran away from the mother and hitch hiked across three states to get home. The kid only called her dad after she was inside Florida and walked around a hundred miles on foot total. The father and I played cute with the court and kept trying to get the mother to tell us where the daughter was or to allow contact. For nine months the mother pretended she knew where the daughter was (was with my client). And on the day of the trial we presented evidence the mother had been lying about knowing where the daughter was. Had the grandmother walk in with the daughter and had her start talking in front of the judge. And opposing counsel was screaming objection after objection and claiming trial by ambush, which it was. And the judge got the mother to admit she had been lying about knowing where the daughter was. And the judge asked me if I had known where the daughter was and I reminded the judge I wasn't under oath nor a party to the action and the judge (a guy) laughed and decided to take an hour to speak to the kid in his chambers. It was epic and i wish we would have had a court reporter (client refused to pay for one, like a fool).

It's a fucked up world guys.

Notice the very first factor the courts consider "The conduct of the parties in the transactions or occurrences that gave rise to the litigation, including any conduct of a party that was reckless, willful, malicious, in bad faith or illegal." Now pair that with how family courts handle false accusations (doesn't matter if women make them) and the Duluth Model (yelling at a woman, denying her money, or denying her affection, denying that her false accusations are true, owning weapons, telling her you're going to leave, this is considered domestic violence).

Yeah when I got divorced I found it quite funny that although it was my ex-wife who hired the lawyer, and I had no one to represent me because I couldn't afford to hire one, it was ordered that I would have to pay for half of her lawyer. I often wondered if I had hired a lawyer, would she then have had to pay for half of my lawyer too?

Fortunately her mom paid for the lawyer completely presumably because she likes me better than her own daughter. She still comes to see her grandkids at my house to this day.

As a single dad with no custody agreement, this terrifes the fuck out of me. Even in cases where it's very clear that the father is the more competent parent they still lean more towards the mother. Especially when she has financial backing from someone. Had a lawyer basically tell me I was fucked unless I had a few hundred grand to spend.

No the lesson learned is as long as women get away with shit they keep doing it and then going another step further. This will only stop once enough men start taking extra-judicial actions against both the women and the judges that allow stuff like this to happen. Saw a program the other day where an 11 y old went missing and ended up dead. Turns out her mom had 5 kids by 3 dads and married a known child molester. Yep, he did it and was thrown in jail. They interviewed the wife after and her comment was something to the effect that she should have made better choices in life. Took the death of her child by a man she brought into the home to wake her up. Disgusting.

Both you and the other person that responded to you are partially correct.

  1. The state does get rewarded by the federal government for collecting child support.

  2. If the Child support is collected by wage garnishment then it first goes into an account owned by the state, which collects interest on that money until it disperses it to the awardees account. States make millions off of that interest.

Either way, the entire system is a corrupt mess of kickbacks and incentives to do the wrong thing.

This same exact thing happened to my (now ex) boyfriend.

He had 3 sons with his ex-wife. She hooked up with a new guy and eventually married him. One day we saw a suspicious post on her MySpace page (this was a few years ago) hinting at her husband being accused of something by a "lying little bitch." Turns out, he had been arrested for molesting a 13-year-old daughter of a friend. However, the ex-wife never informed my boyfriend of this. We were suspicious and googled and found a newspaper article and confronted her. Keep in mind, my boyfriend probably would have never found out about this unless we had come across the post and article.

Ex-wife stood by her husband 1,000%, calling the girl a liar out to get him, etc. She refused to believe he did anything.

Boyfriend immediately contacted his lawyer to get custody (since they lived the majority of the time with the ex-wife and molester new husband.) They went to court but the judge allowed the ex-wife to keep custody BUT made a temporary order for the molester husband to leave the home and live elsewhere.

After a few weeks the judge let the molester husband move back in while he underwent his trial for molestation.

For almost a year, these kids lived under the same roof with this creep while he awaited his trial. All the while, the ex-wife defended him.

Eventually he was found guilty of molestation and sent to prison. Ex-wife STILL stood by him. That is UNTIL she was finally able to read the court documents and victim testimony. Her husband hid it from her the whole time.

Finally when she read the shocking details, she believed he did it. Turns out he had also raped a foreign exchange student of theirs.

So my boyfriend is out like $10,000 in legal fees trying to protect his kids and he wasn't able to do a thing. The only saving grace is that the creep went to prison and was finally out of his kids' lives. (Of course she soon after hooked up with and married another creep with a criminal record.)

The whole thing was heartbreaking and infuriating.

I'm the father to a 12 year old boy, and I have primary custody. His mom moved 4 states away and "Shanghai'd" him last summer. So, after Emergency Custody order, I got him back. Then 6 months of being tied up in the courts, I have custody.

My other son is 7, and I could have custody if I wanted. His mother passed away a few years ago. He lives with his sisters & grandmother, in the only home he's ever known, in the same town as me. So.. I'm OK with it. We are all on good terms. No issues.

Now.. If my ex could just pay her child support!! After I paid her for 10 years, while she raised our children "alone" (bunch of bs). And says I should move away, cuz no one can make a living here, in the area we grew up in. Yet.. she's not paying.. after hounding me for $$ for so many years. Ohhhhh, the turn-about in my life. So satisfying. I haven't even harassed her yet. and she's only like 6 months behind.

I blame the Krauts! America's largest ethnic diaspora is German. The same rot inherent in Germany proper is in German-Americans. a kind of non related story about a kraut I met in college. at a party. I showed up and saw my friends talking with a few girls, I come up and this kraut (from Germany, not American) is there too with his friend also trying to get those girls. I come and introduce myself to everyone I don't know in the group, and to him. he asks if I'm Russian (which I am) right off the bat, I said yes. he says he knew a Russian by the same name in his high school, and then says he kicked his ass... ok... basically implying he'd kick my ass.. in front of the girls and my friends. I look at my friends and they're like wtf. so I said that my grandpa vacationed in Berlin once with his friends and for fun he ran over a bunch of Germans with his tank, implying that we won the war (and my grandpa actually was a tank division commander). the kraut didn't think it's funny and gets in my face so I decked him and sent him to sleep. now they're reaping their own seeds of progressivism and I couldn't give two shits. let em rot.

What state is this in? Because at least here in Florida the father has the same rights as the mother so as long as the father asks for it and he has a place for the child to live he's awarded 50% custody right off the bat. In fact, as the judge told my friend, unless there's proof the father is a drug addict or alcoholic aside from not putting the child's safety at risk he basically has the same exact rights as the mother.

I agree with you, it is messed up how some fathers are treated in a custody case...

On a side note - these sorts of things make me sick. Too many men have fucked things up in the past leading to these laws and others like prohibition. This is one of the main reasons for the marriage strike and why so many men are opting out. The other is the let's be hypersexual until the wedding and then slowly cut off sex game. Both stem from the same thing- POWER. Husbands have been stripped of all power in marriage. Women have been given all power.

In previous cultures men got married to have a family, a wife, a life, and the respect of society. Now they don't get a family because the kids belong to the wife. They don't get a wife but a harridan. They don't get a life but a burden. And respect? LMFAO.

For thousands of years the wife and kids belonged to the husband and the husband literally had the power of life and death over his wife and children (be careful- believe it or not I was banned from Dalrock for saying exactly that!).

In short, the family has been given to the wife. The children belong to the wife. The man gets to play house and family ONLY AS LONG AS THE WIFE PERMITS. The courts will back the wife in every case.
